Terms of Service

By signing up for Atelier Marketing ("Atelier," "we," "our") you agree to these Terms of Service ("Terms"). Please read them carefully. If you don't agree, please don't use the service.
1. The service
Atelier provides AI-powered marketing services to small and local businesses, including (without limitation):
- Generating and publishing social media content on Instagram, Facebook, Google Business Profile, and other platforms you connect
- Responding to reviews and direct messages on your behalf
- Sending SMS messages to your customers requesting reviews
- Producing weekly promotion proposals for your approval
- Providing a dashboard and weekly reports
Specific features and limits may change as the service evolves; we will not materially reduce features you have already paid for without notice.
2. Eligibility
You must be at least 18 years old and have the authority to bind the business you are signing up on behalf of. You agree the information you provide at signup is accurate.
3. Account access and content authorization
You grant Atelier permission to:
- Act as a manager or editor on the social media and business accounts you connect
- Create, schedule, and publish posts to those accounts
- Reply to reviews, direct messages, and comments on your behalf
- Send SMS to customers using your business identity (where you have a lawful basis to contact them)
- Use AI providers to generate content based on your profile
You remain the owner of the connected accounts and can revoke access at any time. Doing so does not entitle you to a refund for service already delivered.
3a. SMS / text messaging program
When you (the client business) enable SMS as part of your Atelier service, the following terms apply between us, you, and your end customers:
Consent
You represent that every phone number you add to your Atelier send list has consented to receive automated text messages from your business. You agree to keep a record of how each customer opted in (verbal at booking, web form, etc.) and to honor opt-outs immediately. Atelier is not liable for SMS sent without proper consent that you obtained.
Carrier-required disclosures (provided to your customers)
- Message frequency varies; typically up to 4 messages per recipient per month.
- Message and data rates may apply per the recipient's mobile carrier.
- Recipients may reply STOP to unsubscribe at any time, or HELP for support.
- Supported carriers: all major US carriers participating in The Campaign Registry (TCR) 10DLC program. Carriers are not liable for delayed or undelivered messages.

Mobile information collected for SMS purposes is not shared with third parties or affiliates for marketing or promotional purposes.
4. Fees and billing
Setup fee
A one-time setup fee of $997 USD is due before service begins.
Monthly subscription
The monthly fee is $897 USD, billed every month starting 30 days after service activation. Pricing may change for new customers; your rate at signup applies for the duration of your continuous service.
Payment
Payments are processed by Stripe. By providing a payment method you authorize Atelier to charge it for fees as they become due. Failed payments will be retried; persistent failure may pause your service.
Taxes
Fees are exclusive of taxes. You are responsible for any sales, use, or VAT taxes applicable in your jurisdiction.
5. Initial term and cancellation
The initial term is 90 days from activation. After the initial term, your subscription is month-to-month. You may cancel anytime after the initial term with at least 30 days' written notice (email to hello@ateliermarketing.net is fine).
6. 90-day satisfaction guarantee
If, at the end of the initial 90 days, your Google review count has not increased by at least 3× AND your verified weekly customer bookings have not increased by at least 50% (each measured against the baseline documented at onboarding), Atelier will refund your most recent monthly fee in full. You retain all content and brand assets produced. Refund requests must be submitted within 14 days of the 90-day mark.
7. Your responsibilities
- Provide accurate information about your services, prices, and hours; tell us when they change
- Respond to approval requests in a reasonable time
- Not post conflicting content via Atelier-managed accounts during the engagement
- Use the service for lawful purposes only
- Not use the service to send unsolicited bulk messages or content that violates platform policies
8. Our responsibilities
- Deliver the service described in Section 1 on the stated cadence
- Never invent services, prices, or commitments not in your documented profile
- Never publish content you have explicitly rejected
- Maintain confidentiality of your customer data and business records, consistent with our Privacy Policy
- Provide reasonable customer support
9. Ownership and license
All content produced under this agreement is owned by you upon publication. Atelier retains a non-exclusive, royalty-free license to use anonymized performance metrics for case studies and product improvement. We will not use your business name or identifiable details in marketing materials without explicit written permission.
10. AI and accuracy
Atelier uses AI models to generate content. We design our system to minimize errors (brand voice gates, never inventing services, owner approval flow for promotions) but AI is not perfect. You are ultimately responsible for content published on your accounts. If anything looks wrong, you can pause your account at any time from the dashboard.
11. Marketing claims
Atelier does not guarantee specific revenue, follower counts, search rankings, or other outcomes beyond the 90-day guarantee described in Section 6. Real results depend on factors outside our control (local market, weather, your service quality, etc.).
12. Termination by us
We may terminate or suspend service if you materially breach these Terms, fail to pay, or use the service for unlawful purposes. We will give you written notice and a reasonable opportunity to cure where possible.
13. Disclaimer of warranties
The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of liability
To the maximum extent permitted by law, Atelier's total liability under these Terms shall not exceed the total fees you paid Atelier in the three months immediately preceding the claim. Atelier will not be liable for indirect, consequential, special, or incidental damages, including lost revenue, lost profits, or business interruption.
15. Indemnification
You agree to indemnify and hold Atelier harmless from claims arising out of: content you supply or instruct us to publish; your use of the service in violation of these Terms or applicable law; and your violation of any third-party rights.
16. Governing law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law principles. Disputes will be resolved by good-faith negotiation first and binding arbitration in Madison County, Tennessee if necessary.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email and on the website at least 30 days before they take effect. Continued use of the service after effective date means you accept the changes.
18. Entire agreement
These Terms, together with the Privacy Policy and any service agreement you sign, are the entire agreement between you and Atelier regarding the service.
